Initiation Notification

 

                  Subject : Initiation of anti dumping investigations concerning import of Hydrodesulpherisation. Zinc Oxide Desulpherisation,  Temperature Shift. Low Temperature Shift. Methanation , and Secondary Reforming Catalysts from Denmark.

 

                  No. ADD/IW/39/95-96 - M/s United Catalysts India Ltd., (UCIL) and M/s Projects and Development India Ltd. (PDIL) have filed a petition in accordance with the Customs Tariff (Amendment) Act 1995 and Customs Tariff (Identification, Assessment and Collection of Anti Dumping Duty on Dumped Articles and for Determination of Injury) Rules 1995, before the Designated Authority alleging dumping of catalysts described in para 3 from Denmark and requested for anti dumping investigation and levy of anti-dumping duty.

 

2.)              Domestic Industry: The petition has been filed by M/s United Catalysts India Ltd., 402/403, Mansarover, 90, Nehru Place, New Delhi-110019 and M/s. Projects & Development India Ltd., Post Box No. 125, A-l4, Section -I. Noida-­201301, District Ghaziabad. U.P. The petitioners have averred that M/s ICI also manufactures two of the subject catalysts. The petitioners, however, account for majority production in India and, therefore, have a standing to file a written request on behalf of domestic industry under the rules aforesaid.

 

3. )             Product Involved: Following are the products under consideration:-

 

      a.         Hydrodesulpherisation Catalysts(HDS): Cobalt-Molybdenum/Nickel-­Molybdenum based catalyst on High Surface Alumina carrier in various forms.

 

      b.         Zinc Oxide Desulphurisation Catalyst (DS): Zinc 0xide based catalysts having specific physical and textural properties, blended with suitable binders.

 

      c.         Secondary Reforming catalyst (SR): Nickel based catalyst on alpha alumina carrier or calcium aluminate compound in the form of Rings/High Geometric Surface Rings.       

 

      d.         High Temperature Shift CO Conversion Catalyst (HTS): An iron chrome and copper promoted iron chrome based catalyst.

 

      e.         Low Temperature Shift CO Conversion Catalyst (LTS): A copper zinc alumina based catalyst.

 

      f.          Methanation Catalyst (METH): A nickel. alumina based catalyst.

 

4)               The subject catalysts are classified under harmonized system code No. 38.15.

 

Dumping:

 

5)               The petitioners have provided fob list price in USA, fob list price in Europe, actual prices in Europe on the basis of orders procured by European companies and export price of the Denmark exporter to third countries in Middle Eat and South East Asia. The petitioners have also submitted sufficient information indicating the weighted average fob export pace to India.

 

6)               On the basis of the information available, there is prima facie evidence that all the subject catalysts are being dumped by the exporters from Denmark.

 

7)               Injury: The various parameters relating to injury such as quantum of imports in absolute terms, market share, import price from Denmark and various indicators affecting domestic industry, such as production, sales, selling prices, stocks, profit and loss, collectively and cumulatively prima facie indicate that the domestic industry has suffered material injury. 

 

8)               There is prima facie evidence  that imports of the subject catalysts originating from Denmark are causing material injury to the domestic industry.

 

9)               Initiation of Anti Dumping Investigation: The Designated Authority, therefore, initiates anti dumping investigation into the existence, degree and effect of alleged dumping of the subject catalysts originating from Denmark.

 

10)             Time Limit and Address for making submissions: The exporters in Denmark and importers in India known to be concern are being addressed separately to make their views known in the form and manner prescribed so as to reach within 40 days of the date of this notification at the following address:

11)             Other interested parties are advised to make their submissions relevant to the investigation in the prescribed form and manner within the time limit set out above.
